Terms & Conditions

This Rental Agreement ("Agreement") governs the rental of non-motorized towed recreational vehicles or motorized equipment (e.g., Toro Dingo TX1000) from Pro Rent LLC ("we," "us," or "our"). By signing, the renter and any Authorized Driver or Operator ("you" or "your") agree to be bound by all terms herein, acknowledge having read the Agreement, and authorize us to process charges and release billing information to third parties for processing.


1. Definitions:

• "Vehicle" includes non-motorized towed recreational vehicles or motorized equipment (e.g., Toro Dingo TX1000), with attachments, awnings, keys, and documentation, potentially equipped with GPS/telematics systems (privacy not guaranteed).
• "Authorized Driver/Operator" is an individual aged 25 or older with a valid driver’s license or operator certification, and for motorized equipment, documented training as required by us or the manufacturer.
• "Rental Period" spans from possession until the Vehicle is returned or recovered and inspected.
• "Vehicle License Fee" recovers our estimated annual licensing, titling, and registration costs.
• Smoking and awning use are prohibited.


2. Renter’s Obligations and Liabilities:

• The Vehicle is rented "as-is," without warranties, express or implied, including merchantability or fitness for a particular purpose.
• You represent that: (a) towing vehicles have adequate capacity; (b) loads are properly secured; (c) motorized equipment operators have completed required training/certification; and (d) all operations comply with laws and manufacturer guidelines, including secure connection of attachments/power sources.
• Return the Vehicle to the designated location on the specified date and time, in the same condition (except ordinary wear), with: (a) empty waste tanks (non-motorized); or (b) same fuel level, securely stored/re-attached attachments, and recorded engine hours (motorized).
• Unauthorized extensions or after-hours returns remain your responsibility, with charges accruing until inspection.
• You are liable for all damage or loss to the Vehicle (trailers or equipment), including: a. Repair costs or actual cash value (if a total loss), less salvage. b. Loss of Use (daily rental rate times days unavailable). c. Diminished Value (per third-party estimate). d. Administrative fees ($50-$250, based on damage estimate). e. Towing, storage, impound, and legal enforcement costs.
• Report accidents, theft, or vandalism to us and law enforcement immediately, providing legible copies of related legal documents (e.g., service of process).


3. Prohibited Uses (Void Insurance): The following are prohibited and void insurance coverage:

• Operation by non-authorized persons, under the influence, with fraudulent information, or for illegal, commercial, or hazardous purposes.
• Overloading, operation outside the U.S./Canada, through low-clearance areas, on unpaved roads (unless manufacturer-approved), or with unsecured cargo/attachments.
• Texting, failing to follow instructions, reckless conduct, using fuel with an octane rating higher than 87 (if applicable), or operating motorized equipment without required training/certification.
• Transporting animals (except service animals), passengers during towing, modifying the Vehicle’s exterior (e.g., signs, loudspeakers), or sitting/standing on the exterior.


4. Insurance Requirements:

• For non-motorized Vehicles, collision/comprehensive insurance your responsibility or accept full liability for damage, loss, or theft.
• For motorized equipment, you must provide collision/comprehensive insurance or accept full liability for damage, loss, or theft.
• Coverage excludes Loss of Use, administrative costs, or Agreement breaches. You must cooperate in loss investigations.
• You provide liability insurance for third-party damage/injury.


5. Charges and Payment Terms:

• Charges include base rental rates, optional services, taxes, surcharges, Vehicle License Fees, cleaning fees (up to $200 if returned dirty), dumping fees, and costs for recovery, violations, or enforcement.
• We may reserve/deposit funds on your credit/debit card, with excess refunded post-rental (up to 21 days). You authorize separate card vouchers and third-party billing.
• You are responsible for traffic violations, tolls, and fines, plus an administrative fee (up to $50 per violation) if we process them.


6. Optional Equipment:

• Equipment (e.g., GPS, Tow straps, Cameras, Trailer hitches ) is rented “as-is” for an additional fee and must be returned in the same condition.
• You are solely responsible for inspecting/installing trailer hitches, two straps, and chains & binders. 


7. Additional Provisions:

• If the Vehicle is inoperable for over 24 hours, our liability is limited to the daily rental rate for the inoperable period.
• We may disclose your personal information to law enforcement or third parties for legal/business purposes.
• No term is waived or modified except in writing signed by us. You waive recourse against us for criminal reports/prosecutions arising from your breach.
• If any provision is void or unenforceable, remaining provisions remain valid. This Agreement is governed by the rental jurisdiction’s laws, excluding choice-of-law rules, and you consent to its courts’ nonexclusive jurisdiction.
• You release us from liability for personal property loss/damage in the Vehicle or our premises.
• We may repossess the Vehicle without notice if abandoned or used in violation of law or this Agreement.
By signing, you confirm understanding this Agreement, authorize charges, and permit billing information sharing. All charges are subject to final audit.
